Aaron Swartz Tribute: Hundreds Honor Information Activist

NEW YORK ? Hundreds of friends and supporters of Aaron Swartz gathered Saturday in New York City to pay tribute to the free-information activist and online prodigy who killed himself last week as he faced trial on hacking charges.

A hero to data-access advocates but a thief in the eyes of prosecutors, Swartz, 26, was found dead Jan. 11 in a suicide that has intensified debate over how authorities should treat hackers whose goal is to expand public knowledge, not make personal profits.

Friends remembered Swartz as a digital-age polymath and a crusader for the open exchange of information ? an "Internet saint," in the words of Quinn Norton, a journalist who writes about hacker and online culture.

Doc Searls, 65, a columnist and advocate for making computer code publicly accessible, said he met Swartz when the tech prodigy was a teenager and noted that the two "were often generational bookends at conferences we went to."

"When we're young we think our cause is a sprint, and when we're middle-aged we thing is it's a marathon," Searls said. "But when we're old we think it's a relay race. And Aaron was the one you wanted to hand it off to."

A grandson of activist folk singer Pete Seeger, Kitama Jackson, read a note from his grandfather that said: "These modern times are filled with such contradictions that experts are not agreed on what the future of the human race will be. But we can agree today that it was a tragedy for this brilliant young man to be so threatened that he hanged himself."

Swartz hanged himself in his apartment the month before he was to go on trial in Boston. Federal prosecutors accused him of breaking into a computer wiring closet at the Massachusetts Institute of Technology in 2010 and tapping into the university's computer network to get millions of paid-access scholarly articles, which he planned to make available for free.

Whatever he aimed to do with the data, "stealing is stealing, whether you use a computer command or a crowbar," Boston U.S. Attorney Carmen Ortiz said before Swartz' death.

But his family, admirers and some legal experts blasted the case as overreaching that drove Swartz to his death. His father, Robert Swartz, has said his son "was killed by the government."

The digital archive that holds the articles, JSTOR, has said it regretted being drawn into the criminal case and didn't pursue any claims against Swartz after he returned the data in 2011. Days before his death, the nonprofit JSTOR announced that it planned to make more than 4.5 million articles available for free.

Swartz had pleaded not guilty to some 13 felony charges. They carried the potential for decades in prison and enormous fines, though prosecutors have said they never intended to seek the maximum penalties.

A shaken Ortiz said this week she was "terribly upset about what happened," appearing near tears at one point as she spoke about the case. But she said her office handled it fairly and appropriately.

Swartz was a young teenager when he helped create RSS, technology for gathering updates from blogs, news sites and elsewhere on the Web. He later co-founded the social news site Reddit and Demand Progress, a group that campaigns against online censorship.

Memorial speaker Glenn Otis Brown, director of business development at Twitter, remembered the precocious 15 or 16-year-old he met while working as the executive director of Creative Commons, which provides a way for people to license their code or online work for public use.

Swartz' role there was to translate legal software-licensing agreements into computer-readable code ? a job he peppered with humor, such as reframing the complex legal concepts as haikus. For example, "Public domain: Do what you feel like / Since the work is abandoned / the law doesn't care," or "If you touch this file / my lawyers will come kill you / so kindly refrain."

Brown recalled a blog post Swartz once wrote about spending 30 days offline: "I felt like I was in control of my life, instead of the other way around."

GOP eyes new election laws

BOSTON (AP) ? After back-to-back presidential losses, Republicans in key states want to change the rules to make it easier for them to win.

From Wisconsin to Pennsylvania, GOP officials who control legislatures in states that supported President Barack Obama are considering changing state laws that give the winner of a state's popular vote all of its Electoral College votes, too. Instead, these officials want Electoral College votes to be divided proportionally, a move that could transform the way the country elects its president.

Republican National Committee Chairman Reince Priebus endorsed the idea this week, and other Republican leaders support it, too, suggesting that the effort may be gaining momentum. There are other signs that Republican state legislators, governors and veteran political strategists are seriously considering making the shift as the GOP looks to rebound from presidential candidate Mitt Romney's Electoral College shellacking and the demographic changes that threaten the party's long-term political prospects.

"It's something that a lot of states that have been consistently blue that are fully controlled red ought to be looking at," Priebus told the Wisconsin Journal Sentinel, emphasizing that each state must decide for itself.

Democrats are outraged at the potential change.

Obama won the popular vote with 65.9 million votes, or 51.1 percent, to Romney's 60.9 million and won the Electoral College by a wide margin, 332-206 electoral votes. It's unclear whether he would have been re-elected under the new system, depending upon how many states adopted the change.

While some Republican officials warn of a political backlash, GOP lawmakers in Michigan, Wisconsin and Pennsylvania are already lining up behind proposals that would allocate electoral votes by congressional district or something similar.

Michigan Gov. Rick Snyder told The Associated Press on Tuesday that he "could go either way" on the change and doesn't plan to push it. But he said it's a reasonable issue to debate and that he prefers that leaders discuss it well before the next presidential election.

"It could be done in a thoughtful (way) over the next couple years and people can have a thoughtful discussion," Snyder said.

Republican leaders in the Michigan Statehouse have yet to decide whether to embrace the change there. But state Rep. Peter Lund, a Republican who introduced a bill to change the allocation system two years ago, said some Republicans might be more receptive to his bill this year following the election.

"We never really pushed it before," he said, adding that the bill wasn't designed to help one party more than the other.

Democrats aren't convinced. And they warned of political consequences for Republicans who back the shift ? particularly those governors up for re-election in 2014, which include the governors of Michigan, Wisconsin and Pennsylvania, among others.

"This is nothing more than election-rigging," said Michigan Democratic Chairman Mark Brewer.

Each state has the authority to shape its own election law. And in at least seven states ? Michigan, Ohio, Wisconsin, Pennsylvania, Virginia, Florida and North Carolina ? Republicans control both chambers of the state legislature and the governor's office.

Already, Maine and Nebraska have moved away from a winner-take-all system to one that allocates electoral votes based on congressional district.

"This is a concept that's got a lot of possibility and a lot of potential," said Washington-based Republican strategist Phil Musser, acknowledging that the debate would "incite different levels of partisan acrimony." Musser also predicted that more pressing economic issues would likely take priority in most Republican-led statehouses.

In Pennsylvania, Senate Republican leader Dominic Pileggi this week renewed his call for the Republican-controlled Legislature to revamp the way it awards electoral votes by using a method based on the popular vote that would have given Romney eight of the state's 20 votes.

Democrats quickly criticized it as partisan scheme.

"It is difficult to find the words to describe just how evil this plan is," said Pennsylvania state Sen. Daylin Leach, a Democrat. "It is an obscene scheme to cheat by rigging the elections,"

Gov. Tom Corbett, who supported a related proposal from Pileggi last year, had not seen the new plan and could not say whether he supports the new version, the Republican governor's spokesman Kevin Harley said.

In Wisconsin, Republican Gov. Scott Walker has said that changing how electoral votes are allocated was an "interesting idea" but that it's not one of his priorities nor has he decided whether he supports such a change.

It's gotten a lukewarm reception in the Republican-controlled Legislature as well. No proposal has been introduced yet and no lawmaker has announced any plans to do so, but the state Assembly speaker, Robin Vos, first proposed the change back in 2007.

"I am open to that idea," Vos said in December as lawmakers prepared for the start of their session. "But I would have to hear all the arguments."

All 10 of the state's Electoral College votes went to Obama last fall under the current system. If they were awarded based on the new system, the votes would have been evenly split between Obama and Romney.

Democratic Milwaukee Mayor Tom Barrett sent an email plea urging people to sign a petition against the change: "We can't sit silently by as they try to manipulate the democratic process for political advantage," Barrett wrote. "We can't let them attack the very democratic institutions and rights that others have sacrificed so much to gain ? just because they don't believe they can win in a fair election fight."

So far, Republicans have only advocated for the change in states that have supported Democrats in recent elections. The view is predictably different in states where the Republican nominee is a cinch to win.

"The Electoral College has served the country quite well," said Louisiana GOP Chairman Roger Villere, who doubles as a national party vice chairman.

He continued: "This is coming from states where it might be an advantage, but I'm worried about what it means down the road. This is a system that has worked. That doesn't mean we can't talk about changes, but we have to be very careful about any actions we might take."

Disruptive Technology: New model, better service, a fraction of the ...

The Walrus and the Carpenter

Disruptive Technology: ?Part 1

It?s been over 4 years since we ran our last article on disruptive technology.?? At that time it was about a new architecture for Servers and Storage oriented technology.? The new architecture called ?virtualization?, utilized existing mature components and enabled businesses to provide better service at a small fraction of the cost.? Virtualization allowed for any number of servers to be consolidated into a single more energy, space and cooling efficient server.? Picture a data center with 19 computer cabinet racks of equipment ? along with the infrastructure they require, operational costs, cooling and manpower now replaced with a single cabinet.? In this model the virtualized architecture pays for itself in less than one year because of the reduction of power and cooling alone.? Now add to that the reduced costs of software, maintenance and manpower and the cost cutting can reach upwards of 90%.

The initial barrier to implementing these technologies was the reduction in manpower.? The business outcome, saving money, is a CEO/CFO function.? But the ?C? level officers of a company aren?t technology savvy about the ?how to?, so they rely on their data center managers.? The data center managers look at the reduction of manpower and think that their jobs are going away; there is resistance.? Humans always resist change.? You don?t need to buy 19 servers and power, cool, license, maintain, update, upgrade, backup and replace them every 3-5 years; you can now get the same performance out of one server for a fraction of the cost.? The manufacturer of this disruptive technology, VMware, has gone from a tiny curiosity of a company to an industry leader in 5 years.? There?s no stopping it.

?That was 5 years ago, ready for the next wave?

The new disruptive architecture is here, now.? Information technologies can now be purchased entirely as a service.? Pay one price and get the latest software operating on your desktop/laptop/mobile device each and every time.? No expired warrantees or no refresh cycle; software is machine independent.? You can purchase the MS-office 365 service and it will always be the latest patched version of the software, all for a determined and metered single price per month.? This remote delivery of services, which some people call ?cloud computing?, is here now.? You need outlook for your email? Simply check off a box on a webpage and it works at your home, at the office or on your mobile.? Firewall security used to require an appliance and an IT department.? Now all you need to do is check off a different box on a webpage and you?ll be protected in the office, at a hotel or on the road.

So here we are at the next crossroads of disruptive technology.? It has gone from mainframes, to mini-computers, to PC?s, to the internet and now to smartphones.? It?s been a remarkable journey, each step with its own proponents, detractors and many imposters along the way.? The change has been fast but disruptive technology cannot be stopped and will always be integrated into our lives.? Each new change impacts our lives in such a way that we can?t imagine living without them just a few short months after their introduction.

62% of the fortune 500 companies that were in business 10 years ago, no longer exist.? If we are slow to change we?ll find that our inability to escape the past will become our inability to create the future.? How can you compete in business If you pay 10x more for your IT architecture than your competitors who use better, faster more agile IT for a fraction of the cost?

Check back next week for our conclusion on disruptive technology.

Chicago Alderman Wants Energy Drink Sales Ban

CHICAGO (AP) -- A Chicago alderman wants to ban the distribution and sale of energy drinks in the city.

Alderman Edward M. Burke cites the popularity of Red Bull, Monster, Full Throttle and 5 Hour Energy among teenagers and young adults and the perceived dangers those drinks pose in his proposed ordinance.

The Chicago Sun-Times reports the proposed ordinance calls for a $100 to $500 fine for each offense.

Industry tracker Beverage Digest indicates energy drinks sales grew 17 percent in 2011, the latest year such statistics are available.

A federal survey, released this month, indicates that from 2007 to 2011 the number of emergency room visits involving energy drinks rose from about 10,000 to more than 20,000.

Beverage manufacturers say the statistics are misleading and taken out of context.

(AP) ? An Algerian military raid to free hostages from at least 10 countries at a remote Sahara natural gas complex and wipe out their Islamist militant captors unleashed bloody chaos, and the British government said Friday that the situation was not yet over.

The fate of the fighters and many of the captives remained uncertain, and dueling claims from the military and the militants have muddied the world's understanding of an event that angered Western leaders.

By nightfall, Algeria's government said the raid was over. But Britain's Foreign Office said Friday morning that "the terrorist incident remains ongoing." It said it could give no further details. Manuel Valls, France's interior minister, said the situation remained murky.

At least six people, and perhaps many more, were killed ? among them Britons, Filipinos and Algerians. Terrorized hostages from Ireland and Norway trickled out of the Ain Amenas plant. Dozens more remained unaccounted for: Americans, Britons, French, Norwegians, Romanians, Malaysians, Japanese, Algerians and the fighters themselves.

"This remains a fluid and evolving situation and many details are still unclear, but the responsibility for the tragic events of the last two days squarely rests with terrorists who chose to attack innocent workers, murdering some and holding others hostage," British Foreign Secretary William Hague told Sky News from Australia.

Algeria's army-dominated government, hardened by decades of fighting Islamist militants, shrugged aside foreign offers of help and drove ahead alone, keeping a tight control of information even to Western leaders.

On Friday, Algeria's ambassador to Japan was summoned by the senior vice minister of foreign affairs, who demanded that Algeria prioritize hostages' lives and cooperate closely.

Prime Minister David Cameron spoke twice to his Algerian counterpart on Thursday and was "prepared for bad news," Britain's Foreign Office said.

A U.S. official said late Thursday that while some Americans escaped, other Americans remain either held or unaccounted for. The official spoke on condition of anonymity because he wasn't authorized to discuss the matter publicly.

The U.S. government sent an unmanned surveillance drone to the BP-operated site, near the border with Libya and 800 miles (1,290 kilometers) from the Algerian capital, but it could do little more than watch Thursday's intervention.

With the hostage drama entering its second day Thursday, Algerian security forces moved in, first with helicopter fire and then special forces, according to diplomats, a website close to the militants, and an Algerian security official. The government said it was forced to intervene because the militants were being stubborn and wanted to flee with the hostages.

The militants ? led by a Mali-based al-Qaida offshoot known as the Masked Brigade ? suffered losses in Thursday's military assault, but garnered a global audience.

Even violence-scarred Algerians were stunned by the brazen hostage-taking Wednesday, the biggest in northern Africa in years and the first to include Americans as targets. Mass fighting in the 1990s had largely spared the lucrative oil and gas industry that gives Algeria its economic independence and regional weight.

Casualty figures in the Algerian standoff varied widely. The remote location is extremely hard to reach and was surrounded by Algerian security forces ? who, like the militants, are inclined to advertise their successes and minimize their failures.

"An important number of hostages were freed and an important number of terrorists were eliminated, and we regret the few dead and wounded," Algeria's communications minister, Mohand Said Oubelaid, told national media, adding that the "terrorists are multinational," coming from several different countries with the goal of "destabilizing Algeria, embroiling it in the Mali conflict and damaging its natural gas infrastructure."

The official news agency said four hostages were killed in Thursday's operation, two Britons and two Filipinos. Two others, a Briton and an Algerian, died Wednesday in an ambush on a bus ferrying foreign workers to an airport. Citing hospital officials, the APS news agency said six Algerians and seven foreigners were injured.

APS said some 600 local workers were safely freed in the raid ? but many of those were reportedly released the day before by the militants themselves.

The militants, via a Mauritanian news website, claimed that 35 hostages and 15 militants died in the helicopter strafing. A spokesman for the Masked Brigade told the Nouakchott Information Agency in Mauritania that only seven hostages survived.

President Barack Obama and Cameron spoke on the phone to share their confusion. White House Press Secretary Jay Carney said the Obama administration was "seeking clarity from the government of Algeria."

Militants earlier said they were holding seven Americans, but the administration confirmed only that Americans were among those taken. The U.S. government was in contact with American businesses across North Africa and the Middle East to help them guard against the possibility of copycat attacks.

BP, the Norwegian company Statoil and the Algerian state oil company Sonatrach, operate the gas field and a Japanese company, JGC Corp, provides services for the facility.

One Irish hostage managed to escape: electrician Stephen McFaul, who'd worked in North Africa's oil and natural gas fields off and on for 15 years. His family said the militants let hostages call their families to press the kidnappers' demands.

"He phoned me at 9 o'clock to say al-Qaida were holding him, kidnapped, and to contact the Irish government, for they wanted publicity. Nightmare, so it was. Never want to do it again. He'll not be back! He'll take a job here in Belfast like the rest of us," said his mother, Marie.

Dylan, McFaul's 13-year-old son, started crying as he talked to Ulster Television. "I feel over the moon, just really excited. I just can't wait for him to get home," he said.

At least one Filipino managed to escape and was slightly injured, the Philippine Foreign Affairs Department said. Spokesman Raul Hernandez said he had no information about any fatalities.

Algerian Interior Minister Daho Ould Kabila said the 20-odd militants entered the country from nearby Libya in three vehicles, in an operation commanded by extremist mastermind Moktar Belmoktar, who is normally based in Mali.

The militants made it clear that their attack was fallout from the intervention in Mali. One commander, Oumar Ould Hamaha, said they were now "globalizing the conflict" in revenge for the military assault on Malian soil.

France has encountered fierce resistance from the extremist groups in Mali and failed to persuade many allies to join in the actual combat. The Algeria raid could push other partners to act more decisively in Mali ? but could also scare away those who are wary of inviting terrorist attacks back home.

Kate Middleton's wedding hotel wins royal warrant

Britain's Queen Elizabeth has awarded a royal warrant to the family-owned London hotel which captured the attention of nearly two billion people around the world when Kate Middleton stepped from its doors on her way to marry Prince William.

The Goring Hotel where the now Duchess of Cambridge spent her last night as a single woman has been awarded a "Royal Warrant of appointment to HM The Queen for Hospitality Services", the hotel said in a statement this week.

Jeremy Goring, whose family built the Belgravia hotel more than 100 years ago, said he believed it was the first royal warrant ever given to a hotel by Queen Elizabeth.

"To be able to display Her Majesty's coat of arms is something that the staff will be enormously proud of," Goring said. "It is made all the more special for us because I believe this is the first Royal Warrant The Queen has ever granted to an hotel."

Royal warrants are a mark of recognition that tradesmen are regular suppliers of goods and services to the royal households, according the official website of the British monarchy.

Strict regulations govern the warrant, which allows the grantee or company to use the legend "By Appointment" and display the royal coat of arms on products such as stationery, advertisements and other printed material, in his or her premises and on delivery vehicles.

The Goring family continues to run the hotel 103 years after it was built by Jeremy's great grandfather in 1910 and prides itself on offering the "very highest levels of hospitality to be found anywhere in the world".

The 69-bedroom hotel located in Belgravia close to luxury shopping in the British capital and Buckingham Palace has been playing host to royal guests since it first opened its doors.

The coronations of George VI and the current queen saw the hotel filled with foreign royalty.

An estimated audience of two billion people tuned in to watch Middleton as she stepped from the hotel to a waiting car to head for her glittering wedding at Westminster Abbey on April 29, 2011.

A stay at the Goring can cost from 290 pounds ($470) per night for a single "queen-bedded" room to 8,400 pounds per night for the two-bedroom royal suite.

TrackBack - Changing Higher Education

Cathy Davidson slideCathy Davidson, ?the?John Hope Franklin Humanities Institute Professor of Interdisciplinary Studies and Ruth F. Devarney Professor of English at Duke University, has just published a post on the HASTAC site that I recommend to all. Its conclusion is clearly conveyed in its attention-grabbing title: If We Profs Don't Reform Higher Ed, We'll Be Re-Formed (and we won't like it). Her message is further underlined by inclusion of the slide (above) which closes many of her presentations.

Davidson discusses four reasons why there is currently a great deal of discussion about replacing professors with computer screens:

(1) Too many students worldwide want to go to college to be able to accommodate them all.

(2)? College in the U.S. costs too much

(3) Online education promises to be lucrative to for-profits

(4)? Our current educational system (kindergarten through professional school) is outmoded.?

?Davidson makes excellent cases for each of these points in her post. She closes by briefly describing some of the efforts she has encountered in her travels that are beginning to address some of these issues. Rather than weakening her excellent arguments by attempting to summarize them, I will simply recommend that you read the original.

I would add another reason to this excellent list that is a slight modification of the 3rd point above:

(5) Online education promises to be lucrative to nonprofits

Just as Davidson says that (3) really bothers her, I will say that (5) really bothers me. Many of the traditional nonprofit universities and colleges are jumping into the online business because they see it as a new source of much needed revenue. As a former administrator, I understand the need for new revenues as much as anyone, so I am a fan of increasing revenues. My concern is that?in most cases?the online initiatives are not being done?in a way that incorporates the online education into the educational mission of the institution - it is a financial, not educational advance. As a result, little emphasis is being placed on educational effectiveness in many of the new online programs. I have great fear that when the educational outcomes of many of these new programs are evaluated, they will be shown to be relatively ineffective. This result will lead many to conclude that online education is intrinsically inferior, when all it will really show is that inferior pedagogy leads to inferior learning.?Nonetheless, such a negative, albeit flawed, analysis could be a big setback in the much needed expansion of effective online learning in higher education. ??

Two dead in helicopter crash in London

A helicopter has crashed during rush hour in central London, killing two people, after it apparently hit a construction crane before exploding into flames.

The helicopter crashed just south of the River Thames near the Underground and mainline train station at Vauxhall, and British spy agency, MI6.

A photo shown on Sky News showed wreckage burning in a street, and a large plume of black smoke was seen rising in the area. Video from the crash scene showed a line of flaming fuel and debris.

Police said the two people died at the scene.

London Ambulance Service said two patients were taken to nearby St Thomas's Hospital with "minor injuries".

Eight fire engines, four fire rescue units and around 60 firefighters plus officers attended the scene of the crash.

London Fire Brigade said firefighters rescued a man from a burning car and brought a blaze caused by the crash under control.

London Fire Brigade said it was called at 8am local time to a report of a crash on Wandsworth Road on the south bank of the Thames.

"There was a flash and the helicopter plunged to the ground. It exploded and you can imagine the smoke coming out of it," Paul Ferguson, an office worker near the scene, told BBC News.

Erin Rogers, who was waiting a bus stop near Vauxhall Station, said she "heard a bang and saw bits of crane debris falling to the floor."

"Then the helicopter was in flames. The rest of the people at the bus station were looking on going 'What was that?"'

Police said the helicopter appeared to have hit a crane.

Early reports indicated the crane was at St George's Wharf, a high rise apartment complex with apartments that offer sweeping river and city views.

The area, roughly 10 blocks from the major Waterloo train and Underground station, is extremely congested during the morning rush hour. Many commuters arrive at the main line stations from London's southern suburbs and transfer to busses or trains there.

"There are tons of emergency services about, and it looks like a helicopter hit a crane of one of the apartment buildings being constructed round there," said Jon Hoeksma, a local businessman.

Honda says to cut 800 jobs in Britain

LONDON: Japanese automaker Honda announced on Friday it intended to cut 800 jobs this year at its Swindon plant in Britain owing to weakening demand for its vehicles in Europe.

"Honda Motor Europe has today announced changes to its UK car manufacturing operation to ensure the long term stability of its future business," the group said in a statement.

"Sustained conditions of low demand in European markets make it necessary to re-align Honda's business structure. As such, Honda... will enter into formal consultation with its associates to consider these changes and the proposal that it will reduce the workforce by 800 associates by spring 2013."

Ken Keir, executive vice president at Honda Motor Europe, added that current "conditions of sustained low industry demand require us to take difficult decisions."

The Swindon plant currently employs about 3,500 staff.

Shadow Inventory and Its Impact on Prices

iStock_000009846698SmallMany analysts differ on what impact shadow inventory will have on house values in 2013. Some warn that these distressed properties will still play a major role in limiting appreciation. Others believe that the increases in buyer demand will more than offset the increase in supply. The only thing on which everyone agrees is that there will be millions of distressed properties that will need to be liquidated over the next few years. How these properties are handled will have an effect on the impact they will have on values.

According to the National Association of Realtors, foreclosures sell at a 20% discount while a short sale sells at a 16% discount. Therefore, a short sale has less of a negative impact on prices compared to a foreclosure. Obviously, if the mortgage is modified, no sale takes place and there is no impact on surrounding home prices.

The U.S. Treasury Department just issued their latest OCC Mortgage Metrics Report which reports on how these distressed properties are currently being handled. Here is a graph showing how these properties are being processed now as compared to a year ago.
